OBJECTIVE:

1790-1817 search in Jackson, Baldwin, Morgan and Clarke Counties for records related to John W. Ray (wife Elizabeth Noble(s)); Joseph and Anna Ray; and Jonathan Noble(s), father of Elizabeth. Specifically, attempt to:
• Determine if John W. Ray (wife Elizabeth Noble(s)) is the son of Joseph and Anna Ray.
• Locate information on Jonathan Noble(s), father of Elizabeth Noble(s) (wife of John W. Ray); and relationship of Stephen Noble(s) to Elizabeth.

INFORMATION PROVIDED:

John W. Ray b. about 1777, d. August, 1821 Lawrence, MS. About 1802, John married Elizabeth Noble(s) believed to be the daughter of Jonathan Noble(s). Elizabeth was born about 1781 and died in or near Hinds County, MS. Their children were: Jonathan b. 1803 in GA; Anna L., b. 1805 in GA; Joseph b. 1810 in GA; William b. ca. 1813 in GA; Elizabeth b. ca. 1815 in GA; John Alexander b. 1817 in MS; and Edward b. ca. 1821 in MS.

Other County Records:

Baldwin County was an original county formed in 1803. An 1861 courthouse fire destroyed Superior Court Records, including all deeds. However, the Ordinary Court (now, Probate Court) records survived. In addition to the estate records mentioned previously, the following Ordinary Court records were searched for Nobles and Ray:
• A search of the index to Baldwin County Estrays, 1808-1819 [GA Archives microfilm 187/41] failed to reveal any reference to Noble(s). There was one Ray entry: William D. Ray, 23 February 1809 , p. 23. [Note: Estrays document stray animals that have been found; the records are particularly useful for locating an individual in a county at a specific point in time]
• Baldwin County Inferior Court Minutes Book A, 1808-1814 [GA Archives microfilm 139/58], p. 17 contains a reference to Stephen Nobles resigning as Clerk of the Court of Ordinary, 4 August 1808. [Because of the poor quality of the microfilm, I was unable to obtain a legible copy]
• A search of the Plaintiffs index to Baldwin County Appearance Docket 1806-1837 [GA Archives microfilm 241/41] failed to reveal any reference to Nobles or Ray.
• A search of Baldwin County Ordinary Minutes, 1807-1811 [GA Archives microfilm 186/36] found no mention of Ray, but did reveal several references to Stephen Noble:

• Ray, John: 1932 letter to the State historian from Carrie Cannon Hannon, descendant of John Ray of GA, probably Lincoln County. Looking for Rev. War service. There was no response in the file from the State historian. However, Ms. Hannon’s letter states that John Ray born in NC married Sussann Vickers and settled in GA before the Revolutionary War. Their Children: Joseph, Elizabeth, Ambrose, Vickers, John, James, Sarah Vickers, Agnes, and Mary Ayers.
• Ray, William G.: Represented Henry County in the Georgia House of Representatives, 1833-1834. A family group sheet states that William G. Ray b. 2 Feb 1802 in Columbia County. Died 7 Jan 1886 Cass County, TX. Married 17 Feb 1824 Henry county; Married Nancy Young (6 May 1801-7 May 1881). She was the daughter of Mr. Young and Miss Britt. William G. Ray was the son of William G. Ray and Elizabeth Langston.
• Ray, William: 1817 Receipt signed by Thomas Townson. The Estate of William Ray dec. – Thomas Townson adm. Received $33 due Ray, a soldier in the Expedition under the command of Genl. McIntosh. Cannot make out location – possibly Franklin Co?

Indian Depredations:

No Indian Depredation Claims were found for Joseph Ray or John Ray. There were, however, several claims that may be of interest.

Noble, William . An 1802 Indian Depredation claiming losses based on a 1784 incident:
“Clarke County. Personally appeared William Nobles senr. & made oath that sometime in the month of July in year of our Lord 1784 He the sd. Wm. Passports to Travel Through Indian Territory were issued by the Governor of Georgia from 1785-1820. Very few of the original applications survive, in those rare instances where the original application exists, it is found in File II. Of the ones mentioned below, there is an original passport application only for Jacob Ray. Since passports were issued by the Governor, they are recorded in Executive Department Minutes. The following comes from Dorothy Williams Potter’s, Passports of Southeastern Pioneers, 1770-1823:
• Stephen Nobles, wife and 7 children. Morgan County. Passport issued 20 Sept 1811.
• Saunders Ray & son Jonas Ray issued a passport on 10 Oct 1801 to travel to the settlements on the Tomor Dun Bigby River.
• Jacob Ray issued a passport on 22 April 1803 to travel to Bigby to see his father.
• Mathew Ray from Edgefield District, SC was issued a passport on 9 Nov 1810
• Jacob Ray of Wilkes County issued a passport to travel to the territory of Mississipi on 7 October 1808.

CHURCH RECORDS:

Two churches in early Morgan County were the Sandy Creek Baptist Church and the Antioch Baptist Church. The Sandy Creek Baptist Church was established in 1808, but the membership lists and minutes do not begin until 1817. There is an early list of “dismissions” in the Antioch Baptist Church and I checked this list through 1820 without finding Ray or Noble(s) among the white male members.

SUMMARY:

I found no will or estate records for Joseph Ray d. ca. 1810 in Morgan County. As previously noted, in addition to searching for estate records in Morgan County, I also checked Clarke, Jackson, Baldwin and Franklin Counties. It’s possible Joseph Ray may have disposed of all of his property (real and personal) prior to his death, in which case there simply was no estate to settle.

Since Joseph Ray transferred land to his sons Robert and Joseph, Jr. in Morgan County, but there was no similar transfer to John W. Ray (also, believed to be his son), I checked Clarke County deeds in hopes of finding that he deeded land to John in Clarke County. Although no deed was located from Joseph Ray to John Ray, there were a number of deeds involving either Ray or Noble(s) that may be of some interest. Copies of these are included.

There was a John Ray of Oglethorpe County, died in 1798 and named, in his will, his wife Jerney (Jency?), sons John, Joseph, Moses, and Nimrod; and daughters Polley, Nancy, Elizabeth, Margaret, Jenessy. In investigating the possibility of whether Joseph Ray mentioned in this will could be the Joseph who was in Clarke County, I checked the 1800 Census of Oglethorpe County . Joseph Ray/Wray is not listed, but there are listings for Mosse Ray; David Wray; John Wray (2 listings); Thomas Wray; and Phillip Wray. One of the John Wray’s was in the 26-45 age category while the other was in the 16 to 26 age category. Mosse Ray was over 45. It seemed feasible that Joseph (brother of John and Moses) could have been old enough to have fathered John W. Ray; and may have left Oglethorpe County after the death of his father in 1798.

It was looking even more promising when Oglethorpe County deeds, 1794-1820 contained no mention of Joseph Ray/Wray after a 1 June 1801 deed of James Ray and Elizabeth, his wife in which they sold the “remaining part of a tract granted to the heirs of John Ray, Senr… after deducting 330 acres of the tract sold by Joseph Ray to Andrew Muckle.” But, then, Joseph married the wrong woman! In Oglethorpe County on 26 July 1803, Joseph Ray married Polley Orr . Since we know “your” Joseph Ray was married to Anney when he sold land in Clarke County in 1807, it seems unlikely that the Joseph of Oglethorpe County is the same person as the Joseph of Clarke and Morgan Counties.

In summary, I found no documentation to connect John W. Ray with Joseph Ray, nor was I able to clarify the Noble(s) family. However, based on the Stephen Noble to Johnston Runnels deed and the 1822 will of William Noble , in which he mentions his son Stephen Noble, a possible scenario emerges : It seems plausible that William Noble, Sr. was the father of William Noble, Jr., Jonathan Noble, and Stephen Noble. William Noble Sr., may have died prior to 1822 and that the 1822 will is that of William Noble, Jr., who named a son after his brother Stephen?

If you are not confused, please read the following:
The John Ray in bold above is probably not our John Ray who married Elizabeth Noble (because of the associated John Jr), but may be the ones found later in Monticello, MS.

The Joseph Ray Sr. and son Robert Ray are probably our relatives as well as Joseph Ray Jr. (also son of Joseph Ray Sr.) shown on other ID postings, i.e. see ID 406 where Joseph Jr. sells the land where his father's plantation was (on Jack's Creek, Morgan County).

ID 86 shows: 1808. John Ray owns land in Clarke (on Freeman Creek) and Baldwin Co (on Little River). The land location and acres match who we thought was our John Ray on Freeman Creek with 165 ac.. So this John Ray who owns land in Baldwin County (on Little River), is shown above. If I am reading this right he also has a son John Jr. and John Sr. is still paying taxes in 1820. ... So, how could this be our John W. Ray?

Still not confused...keep this in mind: ID 18 shows that John W. Ray and Jonathan Ray were on muster rolls at Milledgeville, Baldwin Co, GA 1813-1814. Would they let 10 to 12 year olds be on muster rolls? No minimum age was 16...so this wasn't our Jonathan Ray.

From court and above tax records and land sells (noted on this site) it looks like Joseph Ray Sr. died between 1810 and 1812. If John Ray above wasn't his son what was he doing living next door to Joseph Ray Sr. (on Freeman Crk, Clarke Co.) and answering in court for him after Joseph's death? I think we could figure out this puzzle if the pieces would stop moving.

Looks like a Rene Fitzpatrick( of Baldwin County) informer? Christonia Ray (looks like VS was crossed out and informer inserted) is accusing Christonia Ray who is living in Wilkes County, Christonia came and presented her name to be entered and drawn in the land lottery of the recently acquired lands from the Creek Nation and that she drew lot no 200 in the 5th District of Baldwin County but that lot at the time of inquiry is now in Morgan County. Rene Fitzpatrick filed this information in Morgan County court and was saying that Christonia Ray was not a widow but that she was either a feme covert (married women) and in the case of married women the draw would have been under her husband’s name, or unmarried women (either she never was married or divorced) Rene Fitzpatrick made writ of Scire Facias ( Latin, to be made known, which required the defendant (Christonia Ray to appear in court and prove why an judgment should not be executed against her) That the court of Morgan County is giving notice to Christonia Ray and she is to appear on the Second Monday in August next to appear in their court to defend the loyalty of her claim. (Now this is the interesting part of the document, she was served these documents in Wilkes County in the presence of Usry Ray and Bishop Moore, which tells us her identity) Then below that it says judgment by default so either she didn’t appear or possibly Rene Fitzpatrick didn’t appear but it doesn’t say in whose favor it went, possibly by looking at the Oct. 7, 1810 records in Morgan County records would give more information.

I show a Christiana Hammock married a Sanders/Saunders Ray, some believe her last maiden name was Ussery and thus why they named a son Ussery or Usry. My notes show that most family files show that her husband Sanders Ray died in 1808 in Washington Co., Ala, which was also known as Miss. Territory. He is the one who was ordered to appear in court for leaving his wife Christiana Ray for being old and infirm. So technically she was still married to him when she applied to the land lottery as a widow.

Coverture (sometimes spelled 'couverture') was a legal doctrine whereby, upon marriage, a woman's legal rights were subsumed by those of her husband. Coverture was enshrined in the common law of England and the United States throughout most of the 19th century. The idea was described in William Blackstone 's Commentaries on the Laws of England in the late 18th century. Under traditional English common law an adult unmarried woman was considered to have the legal status of feme sole, while a married woman had the status of feme covert. These are English spellings of medieval Anglo-Norman phrases (the modern standard French spellings would be femme seule "single woman" and femme couverte, literally "covered woman").

A feme sole had the right to own property and make contracts in her own name. A feme covert was not recognized as having legal rights and obligations distinct from those of her husband in most respects. Instead, through marriage a woman's existence was incorporated into that of her husband, so that she had very few recognized individual rights of her own.

As it has been pithily expressed, husband and wife were one person as far as the law was concerned, and that person was the husband. A married woman could not own property, sign legal documents or enter into a contract, obtain an education against her husband's wishes, or keep a salary for herself.

If a wife was permitted to work, under the laws of coverture she was required to relinquish her wages to her husband. In certain cases, a woman did not have individual legal liability for her misdeeds, since it was legally assumed that she was acting under the orders of her husband, and generally a husband and wife were not allowed to testify either for or against each other. Judges and lawyers referred to the overall principle as "coverture".

During the nineteenth century many states began passing Married Women's Property Acts[1] to eliminate or reduce the effects of coverture. Nineteenth-century courts in the United States also enforced state privy examination laws.
